General Information About New York Public Records and Laws
In New York, public records are regularly requested by individuals and businesses that need the information to make decisions or to learn about their past. The state's records also provide for accessing criminal documents to ensure potential employees are a good fit. The New York Freedom of Information Law, which was put into place in 1978 provides for the right for individuals to have access to government information. This law outlines what is considered public record and what information is protected.

What Are Public Records Here?

The Committee on Open Government was created to ensure the law of the state was maintained. This organization also works to help identify what is considered a public record in the state. The records of any government agency remains available, which includes all public corporations, state agencies, authorities and other entities that provide government function. However, it does not include the state's legislature or the court system. The information can be any document or other material in possession of the agency, to include anything kept, filed, produced or reproduced of any agency, including taps, voice recordings, documents, electronic information and others.

The state's laws also put in place a list of particular types of information considered non-public record. This is information that is considered off limits to the general public often because it contains sensitive information that could be used against others or the state. This includes, but is not limited to, the following.

·         Any and all information that is a part of privacy laws, including phone numbers, addresses, taxation and other information
·         All information regarding an open or ongoing criminal case
·         All information that is from a government agency in which the release of the information could lead to risk to the public agency's operations or managements, or to specific information
·         Sealed cases from a court of law
·         Documents that would identify undercover police officers or other private information from public servants

Some information may take a bit of time to access, due to its age or location. Otherwise, information remains available.
