In the state of Nebraska, criminal records are kept on file for any individual that lives, works or commits an illegal action in the state. Criminal records are not always available - they only occur once an individual is arrested for a crime or otherwise charged with one. These records do contain a great deal of information including all misdemeanor and felony charges, though they do not contain driving records or any type of financial information. Criminal records are meant for law enforcement officers and court officials as a way of determining if an individual is a risk or has a previous history of illegal actions.

The state of Nebraska does not have an open records law. Rather, the type of information available to those who request criminal records is limited. The Nebraska State Patrol Criminal Identification Division is the one in charge of managing all fingerprint records and all criminal files. These resources are housed at the office and are under the general control of the state's Attorney General. However, those who wish to gain any assess to this information can only obtain it if they have the proper right to do so.

 Nebraska criminal records are not openly available to the public. Some information included in these reports that are open to the general public include all previous arrest information and any dispositions including convictions, pardons, set aside verdicts and nullified convictions. Individuals who wish to request this information must provide as much information as possible about the individual. At a minimum, this includes a full, legal name, date of birth and Social Security number, though additional information is often required as well. It is possible to request some information or some records by calling 402 471-2194. In addition, it may be possible to obtain a criminal record through local law enforcement. Some individuals may wish to obtain these records for themselves. This is possible to do. The above listed agency can provide that information as well as local agencies. If errors on these reports are present, individuals do have the ability to request removal of that information. It can take several weeks for that to occur.

Nebraska criminal records can be available for most individuals in the state. However, there are restrictions. No juvenile records are a part of this agency’s database that is searchable to the public. This includes all records for those individuals under the age of 18 when the convictions occurred. In addition, these state agencies do not have access to federal information. This means any federal convictions or arrests may not be a part of the state criminal records. However, the Federal Bureau of Investigation, or FBI, does not allow for any general public searches of criminal records for those within their database. Statewide data is available, however, through a computerized database for those who wish to access it.
